Terms of Service
By using Bermcoin (bermcoin.com), you agree to these terms. If you do not agree, please do not use the service. These terms are a legal agreement between you and Bermech Limited, registered in Ireland (CRO 757365), registered office: 6 Fern Road, Sandyford, Dublin 18, D18 FP98.
1. What Bermcoin Is
Bermcoin is an information service. We watch exchange rates and send you notifications when rates hit levels you care about. That is it.
Bermcoin does NOT:
- Handle, transfer, or hold money on your behalf.
- Provide financial advice of any kind.
- Act as a regulated financial entity.
- Recommend when you should or should not exchange currency.
Every notification we send includes a “not financial advice” disclaimer. We mean it.
2. Exchange Rate Data
Our rates are sourced from the European Central Bank's daily reference rate, delivered via the Frankfurter service. Reference rates are published once each working day and are a mid-market benchmark: the rate you actually obtain from a provider will differ after fees and spreads. While we do our best to display accurate, up-to-date information, we do not guarantee the accuracy, completeness, or timeliness of any rate data.
3. Your Account
- You must provide a valid email address to create an account.
- One account per person. Do not create multiple accounts.
- You are responsible for keeping your account secure and for all activity that occurs under your account.
- You must be at least 18 years old to use Bermcoin.
4. Plans & Billing
Paid plans are not yet on sale; the billing terms below take effect when they launch, and the full terms — including renewal and withdrawal rights — will be presented at checkout.
- Free plan — free forever. No credit card required. We will never retroactively charge for the free plan.
- Paid plans — billed monthly or annually via Stripe. Prices are displayed before you subscribe, and we email you before each renewal.
- Cancel any time — you can cancel your paid plan at any time from your Dashboard. Your plan remains active until the end of the current billing period.
- Refunds and withdrawal — if you are an EU consumer, you have a 14-day right of withdrawal on digital subscriptions; how it applies (including any waiver where the service starts immediately) will be set out clearly at checkout. Beyond that, we do not refund partial billing periods: if you cancel mid-cycle, you retain access until the period ends.
- Price changes — if we change pricing, existing subscribers will be given at least 30 days notice before their next billing cycle.
5. Service Availability
We aim to keep Bermcoin running reliably, but we provide the service on a best-effort basis. There is no SLA (service level agreement), particularly for the free plan. We may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will try to give advance notice for planned maintenance.
6. Prohibited Use
You agree not to:
- Scrape or automate — use bots, scrapers, or automated tools to access Bermcoin or extract rate data.
- Resell data — republish, redistribute, or resell any rate data obtained from Bermcoin.
- Impersonate — pretend to be another person or misrepresent your identity.
- Abuse the service — overload our systems, attempt to gain unauthorised access, or interfere with other users.
- Use for illegal purposes — use Bermcoin in connection with any activity that violates applicable laws.
7. Intellectual Property
The Bermcoin name, logo, design, and original content are the property of Bermech Limited. You may not copy, modify, or distribute them without our written permission. Exchange rate data itself is sourced from third parties and is subject to their respective terms.
8. Limitation of Liability
To the maximum extent permitted by Irish law, Bermech Limited’s total liability to you for any claims arising from or related to your use of Bermcoin is limited to the total fees you have paid to us in the 12 months preceding the claim.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or financial losses resulting from actions taken based on rate information provided by Bermcoin.
Nothing in these terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, and nothing in these terms affects your statutory rights as a consumer.
9. Termination
- By you — you may delete your account at any time from Dashboard > Account. See our Privacy Policy for data deletion details.
- By us — we may suspend or terminate accounts that violate these terms, abuse the service, or engage in prohibited activities. We will notify you by email if we take this action, with a reason.
10. Governing Law & Jurisdiction
These terms are governed by the laws of Ireland. Any disputes will be subject to the exclusive jurisdiction of the courts of Ireland.
11. Changes to These Terms
We may update these terms from time to time. If we make material changes, we will notify you by email at least 30 days before the new terms take effect. Continued use of Bermcoin after changes take effect constitutes acceptance of the updated terms.
